The Supreme Court upheld the High Court's decision affirming the entitlement of the respondents to refund a part of the Contributory Provident Fund (CPF) or adjust it for pensionary benefits under the PEPSU Road Transport Corporation Regulations, 1992. The Court noted that the respondents were initially appointed on a temporary basis and their services were transferred to the Corporation without any pension provision until the new regulations were enacted in 1992. The Court held that the respondents, having retired before the introduction of the pension scheme, were entitled to the benefits as per the new regulations, thus affirming the High Court's ruling.
