The Supreme Court, under Section 116A of The Representation of the People Act, 1951, upheld the High Court's decision to set aside the election of Mohammad Sadique from the 102-Bhadaur (Scheduled Caste) Assembly Constituency. The Court found that the appellant, being a Muslim, was not eligible to contest from a constituency reserved for Scheduled Castes, as established under Section 5(a) of the RP Act. The Court affirmed that the appellant's caste certificate was invalid, leading to the conclusion that he was not qualified to stand for election in that constituency.
