Judgment text excerpt

The Supreme Court addressed the entitlement of claimants for benefits under Sections 23(1-A), 23(2), and 28 of the Land Acquisition Act, 1894. The Court held that while the benefit under Section 23(1-A) may not apply due to the precedent set in K.S. Paripoornan v. State of Kerala, the benefits under Sections 23(2) and 28 are still available as established in Union of India v. Raghubir Singh and K.S. Paripoornan v. State of Kerala (1995). The appeals were allowed in part, affirming the applicability of certain benefits under the Act.
