The Supreme Court, in an application under Section 11(6) of the Arbitration and Conciliation Act, 1996, addressed the issue of appointing an arbitrator for disputes arising from sub-contracts related to the Jawaharlal Nehru Stadium renovation. The Court held that the objections raised by the respondent regarding the applicant's standing and the validity of the arbitration clause were insufficient to deny the appointment of an arbitrator. The Court clarified that the correspondence and Letters of Intent indicated that Taiyo Membrane Corporation Pty. Ltd. was indeed a party to the agreements, thus warranting the invocation of arbitration proceedings.
