Judgment text excerpt

The Supreme Court addressed the issue of solatium under Sections 23(1A), 23(2), 28, and 34 of the Land Acquisition Act, 1894, confirming that solatium is payable based on the capitalization method for the value of rubber trees. The Court held that interest on solatium should be awarded from the date of the Constitution Bench judgment in Sunder v. Union of India, and not from an earlier date as claimed by the appellant. The appeal was partly allowed, affirming the High Court's decision on the computation of solatium but clarifying the interest entitlement.
