The Supreme Court ruled that the appellant is entitled to pay Central Sales Tax (CST) at a concessional rate of 1% for the period from 01.04.2009 to 17.06.2009, as per the Industrial Policy of Himachal Pradesh, which extended the concession until 31.03.2013 or until CST is phased out. The Court held that the notification dated 18.06.2009 did not negate the earlier concession but merely reaffirmed it, thus overturning the High Court's interpretation that the concession ceased immediately after 31.03.2009. The outcome favored the appellant, allowing the continued benefit of the concessional rate.
