The Supreme Court held that under Section 20(4) of the Uttar Pradesh Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, a tenant can be protected from eviction if they tender the arrears of rent before the trial court. The Court found that the High Court erred in allowing the revision petition without considering the trial court's findings on the default of rent payment. Consequently, the Supreme Court set aside the High Court's order and restored the trial court's decree for eviction and recovery of arrears of rent.
