Judgment text excerpt

The Supreme Court held that the High Court erred in reversing the decrees of the trial and appellate courts regarding adverse possession. The Court emphasized that the respondents' initial permissive possession did not automatically convert to adverse possession after the decree in O.S. No.295 of 1981 became final on 30th March 1984. The Court ruled that the suits filed by the appellant on 5th September 1996 were within the limitation period, and thus the High Court's decision was set aside, restoring the decrees in favor of the appellant under the Limitation Act, 1963, Section 27.
