Judgment text excerpt
The Supreme Court held that once land has been acquired under Sections 4 and 6 of the Land Acquisition Act, 1894, and possession has been taken, a suit for possession cannot be decreed. The Court found that the respondents had already received compensation for the land, thus rendering the suit invalid. Consequently, the appeal was allowed, the impugned judgment was set aside, and the suit was dismissed without costs.
