Judgment text excerpt

The Supreme Court upheld the decision of the Bombay High Court which dismissed the writ petition challenging the order of the District Judge that set aside the probate granted for a Will executed by Chandrabai under Section 276 of the Indian Succession Act, 1925. The Court found that the trial court had correctly determined the validity of the Will and the entitlement of the appellant to probate. The Court affirmed that the evidence presented supported the execution of the Will, thus maintaining the probate in favor of the appellant.
