MS. S. vs SUNIL KUMAR

The Supreme Court recalled its judgment dated April 10, 2015, convicting the respondent under Section 376(1) IPC and sentencing him to seven years of imprisonment, due to the fact that the respondent had died on October 14, 2012, prior to the hearing of the appeal. The Court held that since the accused was deceased, the appeal had become abated and thus could not be given effect to. Consequently, the judgment was dismissed as it could not be enforced.
