The Supreme Court held that Section 9 of the Arbitration and Conciliation Act, 1996 applies to arbitration proceedings in India and does not extend to those conducted outside India, as established in Bharat Aluminium Co. v. Kaiser Aluminium Technical Services Inc. The Court found that the High Court erred in setting aside the order of the Additional District Judge, which had directed the respondent to furnish security and conditionally attached cargo. The appeal was allowed, reinstating the order of the Additional District Judge.
