Judgment text excerpt

The Supreme Court upheld the constitutional validity of the University Grants Commission Regulations (Minimum Qualifications Required for the Appointment and Career Advancement of Teachers in Universities and Institutions affiliated to it) (Third Amendment) Regulation 2009, which mandates NET/SLET as the minimum eligibility for recruitment of lecturers. The Court found that these regulations do not violate Article 14 of the Constitution as they apply only prospectively, affecting appointments made after the notification date. The judgment also noted the distinction made by the Allahabad High Court in a subsequent ruling, thereby affirming the regulations' applicability to M.Phil. and Ph.D. degree holders not yet appointed as Assistant Professors.
