Judgment text excerpt

The Supreme Court ruled that the Kerala Land Reforms Act, 1964 does not confer fixity of tenure to the respondent-company, as the original lease expired in 1954 and the subsequent claims of tenancy were unfounded. The Court held that the plaintiffs, being joint owners of the property, were entitled to seek eviction and damages for use and occupation, affirming their right to recover arrears of rent from the respondent. The appeal was allowed, and the order of the lower courts was set aside, granting the plaintiffs the relief sought.
