The Supreme Court upheld the validity of the Kamal Vihar Township Development Scheme No. 4 (KVTDS) as planned by the Raipur Development Authority under Section 38(1) and Section 56 of the M.P. (C.G.) Nagar Thatha Gram Nivesh Adhiniyam, 1973. The Court found that the RDA acted within its statutory powers in expanding the scheme area from 416.93 acres to 2300 acres, and that the development plan included provisions for land acquisition and allocation for economically weaker sections. The appeals by the landowners challenging the High Court's dismissal of their writ petitions were therefore dismissed, affirming the scheme's legality and the RDA's actions.
