Judgment text excerpt

The Supreme Court upheld the decision of the Central Administrative Tribunal regarding the applicability of the Pension Scheme to employees of the National Water Development Agency (NWDA) under the guidelines set forth in the Office Memorandum dated 01-05-1987. The Court clarified that the employees of NWDA, being governed by the rules applicable to Central Government employees, are entitled to the benefits of the Pension Scheme unless they opted out. The judgment emphasized that the NWDA's bye-laws do not contravene the provisions of the Pension Scheme as established by the Central Government.
