Judgment text excerpt

The Supreme Court ruled that under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, if an award under Section 11 of the Land Acquisition Act, 1894 has been made five years prior to the commencement of the Act of 2013 and physical possession has not been taken or compensation paid, the acquisition proceedings shall be deemed to have lapsed. The Court held that the appellants' land acquisition proceedings were invalid as they met the conditions set forth in Section 24(2), thereby allowing the appeals and quashing the High Court's dismissal of the writ petitions.
