Judgment text excerpt
The Supreme Court upheld the Bombay High Court's dismissal of writ petitions challenging the Municipal Corporation of Greater Mumbai's Circular dated 12th December 2011 regarding the levy of 'trade refuse charges' (TRC) under Section 394 of the Mumbai Municipal Corporation Act, 1888. The Court found that the TRC, which had been revised significantly, was a legitimate condition for the renewal of trade licenses. The Court affirmed that the Municipal Corporation acted within its authority in imposing these charges, leading to the dismissal of the appeals.
