Judgment text excerpt

The Supreme Court examined the applicability of Section 25U and Section 29 of the Industrial Disputes Act, 1947, in the context of alleged unfair labor practices related to the implementation of the Wage Board recommendations. The Court held that prosecution under the I.D. Act is not maintainable unless there is a violation of an award or settlement, which was not established in this case. Consequently, the appeal was allowed, and the prosecution was quashed as the necessary conditions for liability under the I.D. Act were not met.
