The Supreme Court held that the Mahanagar Sudhar Samiti, formed by elected councillors of the Akola Municipal Corporation, was not registered under the second proviso to Section 31A(2) of the Maharashtra Municipal Corporations Act, 1949, and thus lacked legal recognition as a party for representation. The Court found that the High Court erred in quashing the Resolution dated 29.04.2013, which constituted the Standing Committee, as the application for registration had been previously rejected. Consequently, the appeal was allowed, and the High Court's decision was set aside.
