The Supreme Court held that the prosecution under Section 25U read with Section 29 of the Industrial Disputes Act, 1947 is maintainable only if there is a violation of an award or settlement. The Court clarified that the recommendations of the Wage Board under the Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955 do not constitute an award unless implemented as per Section 17 of the Working Journalists Act. The appeal was allowed, ruling that the complaint was not maintainable due to the absence of a binding award or settlement.
