Judgment text excerpt

The Supreme Court upheld the High Court's decision that the acquisition of land under Section 16(1) and Section 18(1) of the City of Mysore Improvement Act, 1903 was illegal, but refused to quash the notifications due to the long passage of time. The Court directed the allotment of 55 acres of land to J.S.S. Mahavidyapeetha to be reversed, affirming that the appellant is entitled to compensation under the Land Acquisition Act, 1894. Additionally, the Court ruled that the Mysore Urban Development Authority lacked authority to regularize unauthorized constructions under the Karnataka (Regularization of Unauthorized Constructions in Urban Areas) Act, 1991.
