Judgment text excerpt

The Supreme Court addressed the applicability of Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, determining that for a deemed lapse of acquisition proceedings, an Award under Section 11 of the Land Acquisition Act, 1894 must predate January 1, 2014, by at least five years, and possession must not have been taken or compensation paid. The Court found that the Appellants failed to demonstrate non-payment of compensation as they did not follow the required procedure to claim it, thus upholding the Respondent's position. The appeal was dismissed, affirming the validity of the acquisition process followed by the Respondent.
