The Supreme Court addressed the applicability of Article 16(4A) of the Constitution of India regarding the seniority of reserved category candidates promoted earlier than their senior general category counterparts. The Court held that in the absence of a policy decision by the State or rules under the Tamil Nadu Highways Engineering Service, a reserved category candidate cannot claim consequential seniority over a senior general category candidate. The judgment of the High Court was set aside, affirming that the 'catch-up rule' does not apply among promotees under the reservation policy.
