Judgment text excerpt

The Supreme Court remitted the appeal to the High Court due to its failure to consider the relevant judgment in Abubkar Abdul Inamdar (D) by LRs. & Ors. Vs. Harun Abdul Inamdar & Ors. [(1995) 5 SCC 612]. The Court clarified that it did not express any opinion on the merits of the case, allowing the High Court to decide the matter afresh after considering all relevant judgments and submissions. The impugned judgment was set aside with no order as to costs.
