Judgment text excerpt

The Supreme Court ruled that the Uttar Pradesh Avas Evam Vikas Parishad has the authority to implement a Pension/Family Pension and Gratuity Scheme for its employees without requiring further approval from the State Government, as per Section 95 of the Uttar Pradesh Avas Evam Vikas Parishad Act, 1965. The Court clarified that the conditional approval given by the State Government in 1996 did not restrict the Parishad's autonomy in this matter. Consequently, the Court upheld the decision of the Vikas Parishad to transition from a Contributory Provident Fund Scheme to a pension scheme, affirming the legality of the actions taken by the Parishad.
