The Supreme Court addressed the eligibility of teachers in privately managed primary schools and primary sections of high schools to receive salaries from the State Government under various statutes, including the Uttar Pradesh High Schools and Intermediate Colleges (Payment of Salaries of Teachers and Other Employees) Act, 1971, and the Uttar Pradesh Basic Education Act, 1972. The Court held that the primary sections are distinct from junior high schools and thus not covered under the Payment of Salary Act, 1978, reaffirming the legislative intent to treat these categories differently. Consequently, the appeals were decided against the teachers' claims for state salary support.
