Judgment text excerpt

The Supreme Court held that the purchase of a National Savings Certificate (NSC) in the name of a proprietorship concern, M/s. Bhagwati Vanaspati Traders, was invalid as per Rule 17 of the Post Office Savings Bank General Rules, 1981, which stipulates that NSCs can only be issued in the name of individuals. The Court found that the lower commissions erred in allowing the claim based on this irregularity, leading to the dismissal of the appellant's appeal. Consequently, the Court upheld the decisions of the State and National Commissions, ruling that the appellant was not entitled to the maturity amount due to the invalidity of the NSC purchase.
