Ram Kishan & Ors vs State Of Haryana & Ors

The Supreme Court held that under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, land acquisition proceedings initiated under the Land Acquisition Act, 1894, shall lapse if the award was made five years prior and physical possession has not been taken or compensation paid. The Court found that the appellants met these criteria as the award was made on 14.01.2006 and no compensation was paid, thus the land acquisition proceedings were deemed to have lapsed. The appeal was allowed, overturning the High Court's dismissal of the writ petition.
