The Supreme Court held that under Section 125 of the Code of Criminal Procedure, 1973, a wife is entitled to maintenance if she is unable to maintain herself. The Court found that the Family Court's denial of maintenance to the appellant wife was erroneous, as she had stopped working after marriage to care for her family. The High Court's order granting maintenance only from the date of its order was also set aside, with the Supreme Court directing that maintenance should be granted from the date of the application for maintenance instead.
