The Supreme Court upheld the Orissa High Court's decision that employees of the Saraswati Vidya Mandir schools, established by National Aluminium Company Limited (NALCO), are to be considered employees of NALCO under the provisions of the Companies Act, 1956. The Court emphasized that the management of these schools, although contracted out, does not sever the employer-employee relationship with NALCO, thus entitling the employees to the same benefits as other NALCO employees.
