The Supreme Court ruled that under Section 42(3) of The Electricity Act, 2003, the Mumbai Electricity Regulatory Commission has the jurisdiction to direct Tata Power Company Limited (TPC) to supply electricity to consumers who wish to switch from Brihanmumbai Electricity Supply and Transport Undertaking (BEST). The Court held that TPC is bound by the MERC (Standards of Performance of Distribution Licensees, Period for Giving Supply and Determination of Compensation) Regulations, 2005, and must adhere to the timelines specified for providing electricity supply. The appeal by BEST was dismissed, affirming the Regulatory Commission's order requiring TPC to supply electricity either through BEST's network or its own.
