The Supreme Court ruled that High Court Judges appointed from the Bar under Article 217(2)(b) are entitled to have their years of practice as advocates added to their service for pension calculations under the High Court Judges (Salaries and Conditions of Service) Act, 1954. The Court found that the differential treatment between judges elevated from the Bar and those from the State Judicial Service violates Articles 14 and 21 of the Constitution, establishing the principle of 'one rank one pension' for constitutional offices. Consequently, the Court directed that retired High Court Judges should receive enhanced allowances for domestic help and other expenses.
