The Supreme Court ruled that the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 mandates the reservation of 1% of teaching posts for visually disabled individuals in universities, as per Section 33 of the Act. The Court held that the denial of appointment to visually disabled persons in identified posts violates their fundamental rights under Articles 14, 15, and 41 of the Constitution. The Court directed the implementation of these provisions to ensure equal opportunities for persons with disabilities in educational institutions.
