Judgment text excerpt

The Supreme Court referred to a larger bench for clarification on the interpretation of Sections 122 and 123 of The Transfer of Property Act, 1882, due to conflicting judgments in Naramadaben Maganlal Thakker v. Pranjivandas Maganlal Thakker and K. Balakrishnan v. K. Kamalam. The Court held that the revocation deed executed by the appellant was null and void as the gift deed was validly made and accepted, and the appellant failed to prove any vitiating factors such as fraud or undue influence. The appeal was dismissed with no order as to costs.
