The Supreme Court ruled that under Section 24(2) of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, land acquisition proceedings initiated under the Land Acquisition Act, 1894 lapse if no compensation has been paid and the award was made more than five years prior to the commencement of the 2013 Act. The Court upheld the Bombay High Court's decision that the acquisition proceedings were invalid due to non-compliance with statutory requirements, including the absence of a General Body resolution. Consequently, the acquisition was quashed, restoring possession to the landowners.
