Judgment text excerpt

The Supreme Court reversed the Bombay High Court's order quashing criminal proceedings against Narendra Lal Jain and Ramanlal Lalchand Jain under Sections 120-B and 420 IPC, and Sections 5(2) read with Section 5(1)(d) of the Prevention of Corruption Act, 1947. The Court held that the consent decrees in civil suits did not bar criminal prosecution, as the allegations involved conspiracy and fraud against the bank. The appeal by the CBI was allowed, reinstating the charges against the respondents.
