The Supreme Court held that Dr. D.D. Gupta was eligible for promotion to the post of Assistant Professor under the Himachal Pradesh Medical Education Service Rules, 1999, despite the High Court's ruling that his M.D. degree in Pharmacology was not recognized under Section 11 of the Indian Medical Council Act, 1956. The Court found that the Departmental Promotion Committee's reliance on the Medical Council of India's letter was misplaced, as it did not adequately consider the eligibility criteria set forth in the Service Rules. Consequently, the Court overturned the High Court's decision and directed that Dr. Gupta be considered for promotion.
