The Supreme Court held that compliance with Section 50 of the Narcotic Drugs and Psychotropic Substances Act, 1985 is mandatory for the validity of searches and seizures. The Court found that the High Court erred in acquitting the respondents on the grounds of non-compliance, as the respondents had voluntarily consented to the search. The conviction of the respondents under Section 8 read with Section 18 and Section 29 of the NDPS Act was restored, and their sentences were upheld.
