The Supreme Court held that the High Court erred in reversing the trial Court's order allowing the appellant to be added as a party in a suit for specific performance under Order I Rule 10(2) of the Code of Civil Procedure, 1908. The Court established that a beneficiary of a trust has a legitimate interest in the proceedings concerning trust property and should be allowed to participate to prevent prejudice. Consequently, the Supreme Court set aside the High Court's order and reinstated the trial Court's decision to implead the appellant as a party.
