The Supreme Court addressed the applicability of Section 48(7) of the Maharashtra Land Revenue Code, 1966, concerning penalties for unauthorized extraction of minerals. The Court held that excavation for laying building foundations, as part of sanctioned development plans under Section 31 of the Maharashtra Regional and Town Planning Act, 1966, does not constitute unlawful mining. The appeals by the builders' Association and the Nuclear Power Corporation were allowed, overturning the Bombay High Court's ruling that had imposed penalties for such activities.
