Judgment text excerpt

The Supreme Court held that a gift deed executed by Sheikh Hussein in favor of his wife Banu Bibi was valid and conferred absolute ownership of the property to her, as per the principles established in Nawazish Ali Khan v. Ali Raza Khan, AIR 1948 PC 134. The Court affirmed that Banu Bibi had exclusive rights over the property, and upon her death, the respondents, being the legal heirs of Sheikh Hussein, had no claim to the property. The appeal by V. Sreeramachandra Avadhani was dismissed, upholding the lower court's ruling that the gift was irrevocable and not subject to a life interest.
