Judgment text excerpt

The Supreme Court addressed the interpretation of Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, which alters the presumption of innocence for accused persons in drug-related offenses. The Court held that bail for offenses under Sections 19, 24, and 27A, or involving commercial quantities, can only be granted if the court is satisfied that there are reasonable grounds for believing the accused is not guilty. The matter was referred to a larger bench for further consideration due to the implications of Section 80 of the Act and its relationship with the Drugs and Cosmetics Act, 1940.
