The Supreme Court referred a conflict between two 3-Judge Bench decisions regarding the interpretation of 'legality and propriety' under Section 15(6) of the Haryana Urban (Control of Rent & Eviction) Act, 1973. The Court noted that while one decision (Rukmini) held that the revisional court cannot re-appraise evidence, another (Ram Dass) allowed for such re-appraisal. The matter was referred to a larger 5-Judge Bench to resolve this conflict, as similar provisions exist in various rent control legislations, including the Kerala and Tamil Nadu Rent Control Acts.
