Judgment text excerpt

The Supreme Court held that the observations made by the Madras High Court regarding the institution of marriage and customary rights were specific to the facts of that case and do not constitute universal law. The Court reaffirmed the presumption of marriage for couples cohabiting for an extended period, as established in previous judgments including Madan Mohan Singh v. Rajni Kant, AIR 2010 SC 2933. The Court clarified that such observations do not undermine the institution of marriage and are limited to the circumstances presented in the case, thus dismissing the special leave petition.
