The Supreme Court, in Civil Appeal No. 5479 of 2013, upheld the Appellate Tribunal's decision affirming the Odisha Electricity Regulatory Commission's order that M/s. Sesa Sterlite Ltd., as a deemed distribution licensee under the Electricity Act, 2003, is liable to pay Cross Subsidy Surcharge (CSS) to WESCO despite not drawing electricity from it. The Court clarified that being a developer in a Special Economic Zone does not exempt the appellant from CSS obligations. The appeal was dismissed, affirming the lower court's ruling.
