Sesa Sterlite Ltd., as a deemed distribution licensee under the Electricity Act, 2003, is liable to pay Cross Subsidy Surcharge (CSS) to WESCO despite not drawing electricity from it. The Court clarified that being a developer in a Special Economic Zone does not exempt the appellant from CSS obligations. The appeal was dismissed, affirming the lower court's ruling.
