The Supreme Court ruled that the Maharashtra Civil Services (Pension) Rules, 1982 do not apply to teaching staff in colleges, and thus the appellant's prior service from 1950 to 1960 was not counted for pension purposes. The Court held that the Government Resolution dated 11.03.1992, which allows counting past service for pension computation, should have been applied to the appellant's case. Consequently, the Court directed the authorities to consider the appellant's past service for pension calculation, overturning the High Court's dismissal of the writ petition.
