The Supreme Court held that the High Court failed to adequately discuss and re-appreciate the evidence regarding the agreement to sell and the payment of consideration under the agreement dated 17.08.1995. The Court noted that while the appellants did not fulfill their obligation to remove the 'Deosthan Inam' entry from the revenue records, the High Court also did not properly analyze the payment status of the sale consideration. Consequently, the Court set aside the High Court's judgment and remanded the case for a detailed examination of the evidence.
