The Supreme Court held that Section 36 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972 applies exclusively to tenancy land and not to ownership land, thereby ruling that the appellants, who claimed ownership, were not entitled to the protections under this section. The Court reversed the High Court's decision which had dismissed the suit for permanent injunction filed by the appellants against the respondents. The Court reinstated the trial court's decree, affirming the appellants' right to irrigate their land from the well as per the original lease agreement.
