Judgment text excerpt

The Supreme Court held that the High Court erred in allowing the appeal without framing substantial questions of law as mandated by Section 100 of the Code of Civil Procedure, 1908. The Court upheld the trial court's findings that the appellant's suit was barred by limitation and by Section 331 of the UP Zamindari Abolition and Land Reforms Act, 1950, as well as by Section 49 of the UP Consolidation of Holdings Act, 1953. The Court concluded that the appellant had failed to prove fraud or coercion in the consolidation proceedings, affirming the dismissal of the suit.
